This is one of the reasons the new America Invents Act will shaft small businesses in favor of large established corporations. With the first-to-invent system we had inventors could take more time developing an invention to make sure it was marketable before filing the expensive patent. Now with the first-to-file system they will have to rush to the patent office before they get a chance to fully develop their idea. Large corporations have the funding and infrastructure in place to quickly and cheaply file as many patents as they want without worrying about whether the invention is worth it or not. Yet another way government intervention benefits large corporate monopolies and discourages competition.
